No 325. In reference to your telegrams 219 and 220, I saw Acting Minister for Foreign Affairs August 12th and carried out instructions. He stated that having already seen Reuter's telegram concerning the report, he had already telegraphed to the German Emperor and Chancellor of the Empire on the matter, but up to present moment ( 12.M.) Foreign Office was not yet in receipt of any official information from the Governor of Kiaochow. He assured me that German Govt., in accordance with their neutrality, will not delay in taking proper measures in the matter, and telegraph necessary instructions to the Governor. He then said that he was surprised that the Russian cruisers should have escaped the Japanese fleet and entered Kiaochow and hoped that German authorities there did not make any mistakes in dealing with the affair and that I would telegraph  to Tokyo in pacifying sense, for there was no ground to doubt German's neutrality. Upon my remaking thet the fact of so many Russian cruisers entering Chingtao and coaling there appeared as if Russians were going to use Kiaochow as a basis of their operations, Acting Minister said that in no case can such an idea be entertained and German Govt. would not allow such a thing, but he must say that a neutral Power could not prevent a belligerent ship from entering its port, in which case it would of course be treated in accordance with principles of international law.

No. 327.
    In reference to my telegram 325, I saw Acting Minister for Foreign Affairs again on the evening of August 12th. He told me that since I conferred with him this morning German Government had given prompt and sue consideration to the matter, as a result of which telegraphic instructions had just been sent to Governor of Kiaochow, in the following sense.
    Any belligerent ship entering the port shall be allowed to take in coal so as to enable her to reach the next nearest home port, but she must leave the harbour within 24 hours from the time of her entry, and should such ship be disabled from doing so then further period of 24 hours will be allowed. Should any ship refuse to leave within specified time then she shall be disarmed and kept in charge by the authorities.
    Governor was instructed to communicate without delay above decision of German Government to the Commander of the Russian ships.
    Acting Minister for Foreign Affairs said that above was in principle the same as those principles which British Government maintain as being applicable to such cases as the present, end expressed the hope the Japanese Government would be feel satisfied with this impartial treatment of the matter.

No. 226. According to latest reliable information from Kiaochow, Novik, Czarewitch and one destroyer entered the port 11/8. The first named left port after ten hours stay, the second suffered grave damages and intends to remain stationary in the port while the third and two more destroyers which entered 12/8 being all damaged, desire to remain three days in the port. Under the circumstances you are instructed to see German Minister for Foreign Affairs as soon as possible and repeat to him the desire of the Japanese Government as stated in my telegram. 219.

331. In reference to your telegram 226, I saw Acting Minister for Foreign Affairs on the evening of Aug. 13th and drew his attention to points mentioned therein. He was decidedly of the opinion that at the time such report was telegraphed from Kiaochow, Governor was not yet in receipt of instructions mentioned in my telegram 327, which by this time he must have received, and stated that as the latter had been instructed to carry them out strictly, he had not the least doubt that the would be faithfully observed. At the outbreak of the war, he had already been instructed that no belligerent ship should be allowed to stay in port longer than 24 hours and the renewed instructions had special reference to those ships which were disabled. If any belligerent ship therefore exceeded limited time of stay, then she would of course be disarmed and in order to to have such instructions enforced three ? German men-of-war had already been ordered to proceed immediately to Kiaochou. German Government, in deciding upon the course they would pursue in the present instance, had taken also as basis principles of the Japanese regulations with regard to belligerent ships, issued during the Spanish American war. Acting Minister for Foreign Affairs further stated that it was of course understood that besides necessary coal and provisions to reach nearest Russian port, Russian ships would not be allowed to take in arms and ammunitions and that the same ship would not be permitted to enter and coal twice. Thus German Government were doing their best to meet the desire of the Japanese Government and at the same time to strictly maintain their neutrality, and he hoped that a calm view would be taken in Tokio of the matter. I have just received your telegram 227 to which I shall immediately draw attention of Acting Minister.

No. 333. In reference to the last part of my telegram 331, as it was too late last night for me to see Acting Minister for Foreign Affairs, I immediately wrote a private letter to him and drew his attention to the matter. I am just in receipt of his reply dated August 14th which is as follows:-
    "I have at once forwarded your letter of this night to the competent marine authorities, requesting them to furnish me without delay what authoritative news they possess or may obtain concerning the facts alluded to by you. So I hope that I shall soon be able to hand over to you a true and satisfactory statement of the case. Meanwhile I beg leave to bring the following statement before you:-
    Our marine officers Tsingtau have the strictest instructions as to their duties for the maintenance of our absolute neutrality. They know especially that they must not allow that Tsingtau should be made a naval basis by either of the belligerents and that consequently a reentrance of Russian ships in that port is inadmissible. This being so, our highest marine administrative authorities at home refuse to give credit to the news bearing that Russian torpedo-destroyer had reentered the port"
    I hear that it is probable that the German Govt. will shortly issue regulations concerning ships of a belligerent Power which should enter a German port.

No. 339. Reports from Tsingtao agree in stating that at noon August 15th flags of Czarevitch and 3 destroyers were pulled down in presence of German Governor with speeches on both sides, and further that German authorities received instruction from Berlin to the effect that sea-worthy ship must leave immediately and sea-unworthy ships will be repaired under German supervision just to make navigable. Nothing should be done about fighting power but curiously enough no mention was made in these reports about disarming so far.
    The above telegraphed to Minister Uchida and Consul General Odagiri.
